Thank you for your interest in the 2019 San Diego Margarita Fest!

Our vendor area is the ideal opportunity for local and regional businesses to showcase their products and services to our highly desirable and attentive millennial attendees.

We strongly recommend submitting your application and payment early, as space is limited and our vendor area will sell out quickly.

Hours: 11:00am to 10:00pm
Vendors MUST be operational for all hours of the festival.
Age: 21 & up (working staff included)

2019 VENDOR AGREEMENT

To apply for participation in the San Diego Margarita Fest event, please:

  1. Read and acknowledge your understanding of the following rules and regulations.
  2. Complete the online application below in full and sign electronically.
  3. Submit your payment in full upon applying to participate.
  4. You are not confirmed for participation until we review/approve your application and receive payment in full.

VENDOR PARTICIPATION FEES

  • 10’x10’ Space – $1,000.00
  • 10’x10’ Space with Sampling* – $1,500.00
  • 10’x20’ Space – $1,800.00
  • 10’x20’ Space with Sampling* – $2,300.00
  • Larger Space – Additional cost specified by your sales representative
  • Corner Space – Available on a limited basis for an additional fee of $500.00

*Sample size not to exceed 3oz per person (no alcohol allowed)

PARTICIPATION FEE INCLUDES:

  • Your requested space (exact location TBD)
  • One (1) 20 amp / 110 Edison style power outlet
  • Trash removal services
  • Ability to promote your business

VENDOR PARTICIPATION TERMS:

  1. PARTICIPATION CONFIRMATION: The San Diego Margarita Fest reserves the right to choose and confirm all vendors. Once you are confirmed as a participant and your participation fee has been deposited, no refunds will be issued, for any reason whatsoever.
  2. LOCATION: Vendor space assignments will be at the sole discretion of the San Diego Margarita Fest. Please do not ask for specific booth locations or to be moved. Vendors will receive their space assignment upon loading into the Event site.
  3. TENTING: VENDOR MUST USE A BRANDED CORPORATE TENT OR PROFESSIONAL POLE TENT. Unbranded/generic pop-up tents are not permitted without prior approval from SDMF.
  4. HOURS OF OPERATION: Vendors MUST be operational for all hours of the festival. If you fail to operate during the scheduled Event hours, you will not be allowed to return to next year’s San Diego Margarita Fest. Hours of Operation – Saturday, August 17th, 2019 – 11am to 10pm
  5. POWER: The San Diego Margarita Fest will supply one (1) 20 amp / 110 Edison style outlet circuit for use at your booth. Vendors must provide any needed power strips or extension cords. All Vendor-supplied equipment must be in excellent working order and safe for use in outdoor conditions.
  6. NOISE AND GENERATORS: Bringing your own generator is strictly prohibited. Vendors are not allowed to operate music or public address systems on the Event site. This includes stereos, televisions, D.J. equipment or megaphones.
  7. SIGNAGE: All signage and display items must be contained to Vendor’s contracted area at the Event and are subject to approval, adjustments or restrictions by SDMF. The San Diego Margarita Fest, reserves the right to reject any inappropriate or unprofessional signage.
  8. VEHICLE ACCESS: Vendor may utilize vehicles to move equipment and goods to the site up to 3 hours prior to the start of the Event. You may drop off your goods and then you must immediately remove your car from the Event site. You may not load out until the Event hours have come to an end, the festival area is free of pedestrians, and RETF gives you permission to do so.
  9. PERMITS: Vendor is responsible for obtaining the appropriate permits from local authorities for their operation. Copies of the approved permits must be submitted by Vendor to SDMF 30 days in advance of the Event. All required permits must be visibly displayed at Vendor’s contracted area at all times.
  10. TRASH AND CLEAN UP: Vendor must maintain the cleanliness of their contracted area. All trash must be tied off in drawstring-style trash bags. Your contracted area must be 100% free of all trash and display items at the end of the Event. At close, completely break down and remove the contents of booth area. Your area should appear as you found it at load in. You must leave your area 100% free of all trash and display items at the end of the event. Anything left behind (including rental equipment) will be thrown away.
  11. PROHIBITED MERCHANDISE: The following items are not authorized and MAY NOT BE SOLD BY ANY VENDOR AT ANYTIME. If any Vendor is found selling any of the following items, they will be asked to leave the Event site immediately and forfeit 100% of their participation fee. Prohibited items are as follows:
    • Unauthorized (i.e. bootleg materials) national or private brand products of any kind, including clothing or other wearable apparel, leather goods, personal accessories, videos, DVD’s, CD’s, cassettes, or other electronic items.
    • Food/beverage sales or giveaways of any kind are prohibited unless written approval is given by SDMF in advance of the Event.
    • Merchandise of any kind containing the logos, phrases, or words connected with SDMF and/or the Event unless written approval is given by SDMF in advance of the Event.
    • Pornographic or publicly offensive merchandise, drug paraphernalia or any other items that conflict in keeping with standards of public policy and local ordinances.
  12. SALES TAX: Vendor is responsible for collecting, reporting and paying all applicable taxes.
  13. PUBLICITY: The San Diego Margarita Fest reserves the right to utilize any photographs or video taken of the Vendor, Vendor Footprint, or Vendor interactions at the Event, in all forms and media and in all manners, including composite or distorted representations, for advertising, trade, publicity purposes, or any other lawful purposes.
  14. SECURITY: Vendor is responsible for the security of their contracted area, goods and personal items. Vendor will bear the risk of loss for its contracted area, goods, and personal items. Although there will be 24-hour security provided for the Event area, it is suggested that all items of value should be removed as needed. At no time, will SDMF be liable for lost, damaged or stolen items. SDMF will not be liable to the Vendor for any damage or injury caused to them or their persons, business or property by persons attending the Event, or by any other reason. Vendor agrees to take any, and all precautions as they, in their sole discretion, believe necessary and appropriate to protect their interests from such risks.
  15. OPERATIONS: San Diego Margarita Fest reserves the right to restrict the Vendor with respect to operations and display of materials.
  16. INTOXICANTS: Vendor may not possess or use illegal drugs, alcohol or other intoxicants inside or anywhere near the Event footprint.
  17. INSURANCE: Vendor shall provide Commercial general liability insurance, including broad form contractual liability, personal injury liability, advertising liability, and products/completed operations liability coverage with minimum liability of $1,000,000 each occurrence, $2,000,000 general aggregate, and $2,000,0000 products/completed operations aggregate. As applicable, auto liability insurance covering owned, non-owned and leased or hired vehicles with the minimum amounts of $1,000,000 each accident. As applicable, workers compensation insurance during the dates they are working at the San Diego Margarita Fest. All-risk property insurance covering personal property owned, leased, rented, borrowed or used by Vendor for full replacement cost, which will include a waiver of subrogation in favor of SDMF. Vendor will name San Diego Margarita Fest, San Diego County, Citicasters Co. an affiliate of iHeartMedia, Inc., Southport Marketing, Inc., and JKY Holdings, LLC as an additional insured and provide SDMF with satisfactory proof of insurance, 30 days prior to August 17, 2019. The Vendor shall immediately notify SDMF in writing of any lapse, cancellation or modification of the insurance coverage required herein.
  18. FORCE MAJEURE: In the event of inclement weather, or for any reason whatsoever that the San Diego Margarita Fest is delayed, rained-out or unfeasible by any act or regulation of any public authority or bureau, civil tumult, strike, epidemic, war conditions, emergencies, act of God or any other cause or causes beyond the control of the San Diego Margarita Fest, the Vendor agrees that there shall be no claim or action against the San Diego Margarita Fest. Attendance is not guaranteed, and no refund of Vendor participation fees will be given for any reason.
  19. INDEMNIFICATION: The Vendor shall release, indemnify and hold harmless the San Diego Margarita Fest, San Diego County, Citicasters Co. an affiliate of iHeartMedia, Inc., Southport Marketing, Inc., JKY Holdings, LLC, all sponsoring organizations and all trustees, officers, employees and agents from any and all liability, claims, suits, actions, damages, settlements and expenses, including reasonable attorney’s fees, arising out of injuries to persons or damages to property directly and exclusively resulting from said Vendor’s actions and participation in the San Diego Margarita Fest Event. The San Diego Margarita Fest, or any subsidiary thereof, will not be responsible for any kind of injury sustained by participants or guests while in agreement. By signing this release and request, you agree to follow all rules and policies as outlined in these documents and/or any addendum thereto.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

In consideration for participating in San Diego Margarita Fest dated Saturday, August 3, 2019 and other valuable consideration, the Vendor hereby RELEASES, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the San Diego Margarita Fest, San Diego County, Citicasters Co. an affiliate of iHeartMedia, Inc., Southport Marketing, Inc., JKY Holdings, LLC, their officers, servants, agents, agencies, and employees (hereinafter referred to as RELEASES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted or in transportation to and from said premises.

To the best of Vendor’s knowledge, the Vendor can fully participate in this activity. Vendor is fully aware of risks and hazards connected with the activity, including but not limited to the risks as noted herein, and I hereby elect to voluntarily participate in said activity, and to enter the above-named premises and engage in such activity knowing that the activity may be hazardous to me and my property. THE VENDOR VOLUNTARILY ASSUMES FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise.

Vendor further hereby AGREES TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any loss, liability, damage or costs, including court costs and attorney’s fees, that may incur due to my participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise.

It is Vendor’s express intent that this Release and Hold Harmless Agreement shall bind the members of SDMF ownership, shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. The Vendor hereby further agrees that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Iowa.

THE VENDOR UNDERSTANDS THAT SDMF OWNERS WILL NOT BE RESPONSIBLE FOR ANY MEDICAL COSTS ASSOCIATED WITH AN INJURY THE VENDOR OFFICERS, EMPLOYEES OR ANY OTHER OF ITS ASSOCIATES MAY SUSTAIN. The Vendor further agree to become familiar with the rules and regulations of SDMF concerning conduct and not to violate said rules of any directive or instruction made by the person or persons in charge of said activity and that Vendor will further assume the complete risk of any activity done in violation of any rule or directive or instruction.

The Vendor also understands that it should and is urged by SDMF to obtain adequate health and accident insurance to cover any personal injury to SDMF working staff which may be sustained during the activity or the transportation to and from SDMF. The Vendor also understands that it is solely responsible for any damage it causes to the facilities, premises, property of the San Diego Margarita Fest, San Diego County, Citicasters Co. an affiliate of iHeartMedia, Inc., Southport Marketing, Inc., JKY Holdings, LLC, or property of others.
